British couple sentenced after children left alone in Benalmádena hotel

A British couple have been handed suspended prison sentences after leaving their three young children alone in a Benalmádena hotel while they went out, in a case that has raised serious child welfare concerns on the Costa del Sol.

The man, aged 41, and woman, aged 28, were sentenced to 16 months in prison for abandoning minors after a fast-track hearing at the Juzgado de Instrucción nº 3 in Torremolinos. The sentence was suspended on condition that they do not reoffend during the next two years. 

The couple have also been banned from approaching within 500 metres of the children for two years and disqualified from exercising parental authority for two years and eight months. 

Children found alone in hotel

The case began on Wednesday evening when National Police officers were alerted that three small children had been left alone at a hotel in Benalmádena, one of the Costa del Sol’s busiest holiday resorts.

Spanish reports say the children were aged four, around one or two depending on source, and six months. Police found them in worrying conditions, with the eldest child reportedly trying to look after the younger siblings. 

The parents were later located and arrested in another part of the tourist complex. Initial reports said they had gone out partying, leaving the children without adult supervision. Two children tested positive for cocaine

After the police intervention, the three children were taken to Málaga’s Hospital Materno Infantil for medical assessment.

Spanish reports say two of the minors tested positive for cocaine. Earlier reports had focused on the baby, but later Spanish coverage, including El País and Cadena SER, said two of the children gave positive results. 

The exact circumstances of how the children came into contact with the drug have not been detailed publicly in the court reports seen so far.

Children placed under social services care

The three children are now under the protection of Andalucia’s social services.

Reports say the Junta de Andalucía has taken charge of their care and is coordinating with the British consulate to arrange their transfer to the United Kingdom. 

Earlier reports said the children had initially been placed with foster families, with the intention of bringing them together in the same environment as soon as possible. 

The case has moved rapidly because it was handled through a fast-track process, known in Spain as a juicio rápido, after the couple accepted the facts in court. 

Court imposes distance and parental authority measures

The suspended prison sentence means the couple will not enter prison provided they comply with the court’s conditions and do not commit another offence during the suspension period.

However, the other measures imposed by the court are immediate and significant. The parents cannot go within 500 metres of the children for two years, and they cannot exercise parental authority for two years and eight months. 

These measures reflect the seriousness of the child welfare concerns and the need to keep the minors under protection while their future care is arranged.

A serious warning for holidaymakers

Benalmádena is one of the Costa del Sol’s most popular family holiday destinations, with hotels, resorts and tourist complexes welcoming large numbers of British visitors every year.

The case is unusual in its severity, but it underlines a simple legal reality: parents and guardians remain responsible for children’s safety at all times while on holiday in Spain. Leaving young children alone in a hotel room, apartment or resort area can trigger police intervention, social services involvement and criminal proceedings.

For the three children involved, the priority is now their protection, medical follow-up and safe return to a stable care environment.

The court sentence closes one part of the case, but the child welfare process will continue under the supervision of the relevant authorities.
