The Errejón trial notice date has been set for Tuesday, 17 February, after a Madrid judge confirmed he will proceed with the next procedural step in the case involving former MP Íñigo Errejón and the actress Elisa Mouliaá.

Judge Adolfo Carretero has summoned Errejón to court to be formally notified of the opening of trial proceedings. The move comes after the judge ruled that a previous attempt to withdraw from the case was not legally valid, meaning the private prosecution remains in place.

What the case is about

The case centres on a complaint filed by actress Elisa Mouliaá, who alleges an incident involving Íñigo Errejón after a public event in 2021. Moreover, Spanish coverage has described the allegation as non-consensual kissing and sexual touching, which Errejón denies.

The complaint was filed in October 2024, around the time Errejón resigned from politics after allegations about inappropriate behaviour were circulating publicly.

In recent weeks, the procedural focus has shifted. Mouliaá indicated she intended to withdraw her private prosecution, but the judge later ruled that the withdrawal was not formally valid, and she subsequently confirmed she would continue.

Why the judge refused to accept the withdrawal

The key twist this week wasn’t a new allegation or fresh evidence, but a procedural one.

Mouliaá had indicated she was stepping back from the case, but the judge found the withdrawal had not been properly ratified through the court process (including the formal requirements around legal representation). In a later filing, she confirmed she would continue.

That decision keeps the case moving towards the “juicio oral” phase — even as the wider legal picture remains contested.

Tuesday’s appearance is not the trial itself. It is the point at which the defendant is formally served with the court order opening the trial stage.

In parallel, Spanish media report that an appeal is still pending before the Audiencia Provincial de Madrid, which will have to decide whether to uphold or overturn the judge’s decision to send the case forward.

The prosecution’s position adds another layer

One reason the story continues to draw attention is that the public prosecutor’s office had sought to close the case, arguing there were insufficient grounds to proceed — a view the judge has rejected at this stage, saying there are indications that justify continuing the process.

Errejón is a high-profile figure in recent Spanish politics and has been linked to the national left in multiple roles, which is why the case is followed closely beyond the courts.
