A plumber in Spain has been sentenced to five and a half years in prison after defrauding a 76-year-old woman of almost €80,000. Silverio M.M., previously convicted of fraud, exploited the elderly woman’s declining cognitive health, charging exorbitant fees for unnecessary boiler repairs.

The High Court of Castilla y León upheld an earlier ruling from Valladolid, finding Silverio guilty of deliberate and sustained deception. The victim lived alone, relying solely on a monthly pension of €736. Over months, the plumber repeatedly contacted her, demanding payments ranging between €500 and €1,000 for parts he falsely claimed were essential.

Occasionally, Silverio collected cash in person. He drove the victim to her bank other times, waiting outside as she withdrew money. She meticulously documented each transaction, eventually spending a total of €79,692. Her savings dwindled to less than €200, leaving her financially ruined.

“My life has completely changed”

Testifying emotionally in court, the victim explained that her passion for travel had been entirely lost. “All I have left is my pension and a few euros in the bank,” she told judges. Her niece, who discovered the fraud and helped file a police complaint, confronted Silverio directly, astonished at the amount taken: “A boiler costs around €400. You’ve basically bought yourself an apartment.”

The victim lacked the resources to afford legal representation, preventing her from formally joining the prosecution.

Court dismisses plumber’s defence

Silverio’s lawyer argued for acquittal, questioning the reliability of the victim’s memory and suggesting possible interference by her niece. However, police investigations uncovered clear evidence, including handwritten notes aligning payments precisely with Silverio’s calls and visits.

Importance of vigilance and recommendations

This case highlights the urgent need for elderly residents and their families to exercise caution and seek recommendations before allowing strangers into their homes. It is sadly also common for criminals to masquerade as service workers, such as boiler inspectors, to gain entry and commit theft or fraud. Ensuring trusted references, verifying identities, and remaining vigilant can significantly reduce the risk of such crimes. Exploiting the elderly is a particularly disgraceful act, underlining the importance of community awareness and protective measures.

Justice served 

The court described the evidence as overwhelming, especially given Silverio’s prior conviction. He must now repay the €79,692 in full. However, recovery remains uncertain.

This case, receiving significant public attention, has exposed concerns regarding elderly exploitation in Spain.
